RealHealers Referral Program Terms

Rules for participating in the RealHealers Referral Program and for granting and paying out Promotional Benefits (Referral Circle). The Polish version is binding.

1. Definitions

Organizer — RealHealers GmbH, with its registered office at Glatthof 6, 9245 Oberbüren, Switzerland, registered in the commercial register of the Canton of St. Gallen, using the e-mail address: kontakt@realhealers.com, hereinafter also „RealHealers” or „Organizer”.

Service — the website operated by the Organizer at https://realhealers.com/, enabling in particular the presentation of healer/practitioner profiles and the booking of services offered through the Service.

Program — the promotional campaign under the name „RealHealers Referral Program”, organized by the Organizer on the terms set out in these Terms.

Terms — these terms of the Program.

Participant — a Guide (Przewodnik) who has accepted the Terms and takes part in the Program.

Invited Guide — a person who, through a Participant's Referral Link or Referral Code, registers an account in the Service as a Guide and meets the conditions set out in the Terms.

Referral Link/Referral Code — the individual link or code made available to the Participant by the Organizer within the Program.

Paid Booking — a booking of an Invited Guide's service made and paid for by a client through the Service, which has not been cancelled, refunded, disputed, or charged back.

Platform Fee — the remuneration due to the Organizer from the Invited Guide for using the Service, in accordance with the Service terms or the agreement concluded with the Guide.

Guide (Przewodnik) — an entrepreneur (a natural person conducting a business activity registered in CEIDG, holding a tax ID NIP) or a person conducting unregistered activity within the meaning of the Act of 6 March 2018 — Entrepreneurs' Law (PL), who provides their services through the Service.

Promotional Benefit — the monetary benefit paid to the Participant by the Organizer for participating in the Program, financed by the Organizer from its own funds or from the Platform Fee.

2. General provisions

The Terms set out the rules for participating in the Program and for granting and paying out Promotional Benefits.

The Program is a promotional campaign of the Organizer directed at Guides who hold an account in the Service. The Program is not directed at end clients using the Guides' services.

The Program is not a lottery, contest, game of chance, or mutual wager within the meaning of gambling regulations.

Participation in the Program is voluntary and requires prior acceptance of the Terms.

The Participant should be able to review the Terms before using the Referral Link or Referral Code and before the accrual of Promotional Benefits begins.

The Program is in effect from 28 June 2026 until revoked or until the day indicated by the Organizer. The Organizer will give notice of the Program's termination at least 30 days in advance via the Service or by e-mail.

3. Nature of the Program

The Program is a promotion of the Organizer and does not constitute an intermediation, agency, or marketing service provided by the Participant for the Invited Guide, nor a payment service.

The Promotional Benefit is paid to the Participant by the Organizer. It does not form part of the Invited Guide's remuneration, nor is it funds transferred to the Participant by the Invited Guide through the Service.

The Participant is not entitled to accept payments from clients, Invited Guides, or other persons on behalf of the Organizer or the Invited Guide.

The Participant is not entitled to represent the Organizer, make statements on its behalf, conclude agreements on its behalf, or bind the Organizer toward third parties.

Any reference in the Terms or in the Service to the Platform Fee serves solely to determine how the Promotional Benefit is calculated and does not mean that the Participant acquires a claim to part of the Invited Guide's remuneration.

4. Conditions of participation

A Participant in the Program may be a person who jointly: holds an active Guide account in the Service; has accepted the Terms; is not suspended or excluded from using the Service; has provided the data necessary to settle the Promotional Benefit, including identification and tax data and a bank account number, if required; has undertaken to conduct activities within the Program in accordance with the law.

The Organizer may grant selected Participants the status of Ambassador. The status of Ambassador, the amount of the Promotional Benefit, and additional conditions of participation may be determined individually by the Organizer.

The Participant may not refer themselves or create fictitious accounts in order to obtain a Promotional Benefit.

The Organizer may refuse to grant or pay out the Promotional Benefit if it forms a reasonable suspicion of abuse, circumvention of the Terms, unlawful action, or action harming the Organizer's good name.

5. Referral rules

To participate in the Program, the Participant may share their Referral Link or Referral Code with persons who may be interested in registering in the Service as a Guide.

The Invited Guide should register an account in the Service using the Participant's Referral Link or Referral Code.

If several persons refer the same Invited Guide, the Promotional Benefit will be assigned to the Participant whose Referral Link or Referral Code was correctly used first, unless the Organizer decides otherwise.

The Referral Link may be active for the period indicated in the Service, in particular for 90 days from the click by the Invited Guide, unless the Organizer indicates a different period.

The Participant undertakes that the activities undertaken within the Program, including sending invitations and sharing the Referral Link or Referral Code, will be conducted in accordance with applicable law, in particular regulations on the protection of personal data, the provision of electronic services, electronic communications, marketing consents, and the prohibition of sending unsolicited commercial information.

The Participant may not conduct misleading, aggressive, or spam activities, infringe the rights of third parties, or suggest that they act as an employee, agent, or representative of the Organizer.

6. Conditions for accruing the Promotional Benefit

The Promotional Benefit accrues if the following conditions are jointly met: the Invited Guide has registered an account in the Service using the Participant's Referral Link or Referral Code; the Invited Guide has begun using the Service as a Guide; a client has made a Paid Booking of the Invited Guide's service; the Organizer has received and retained the Platform Fee from that booking; the booking has not been cancelled, refunded, disputed, or charged back.

The Promotional Benefit amounts to: for a standard Participant — 10% of the Platform Fee obtained by the Organizer from the Invited Guide's Paid Bookings; for a Participant holding Ambassador status — 20% of the Platform Fee obtained by the Organizer from the Invited Guide's Paid Bookings; or another value indicated in the Service or individually agreed by the Organizer and the Participant.

The 20% rate is available to a Participant holding Ambassador status for a period of 6 (six) years counted from the day the Ambassador status is granted. After this period elapses, the Promotional Benefit for referrals covered by the increased rate ceases to accrue. The standard rate of 10% of the Platform Fee is available indefinitely, on the terms set out in the Terms.

The Promotional Benefit may accrue on subsequent Paid Bookings of the Invited Guide without a predetermined limit on the number of bookings, for as long as: the Invited Guide holds an active account in the Service; the Participant holds an active account in the Service and has not been excluded from the Program; the Program is in effect; the conditions of the Terms are met.

The Promotional Benefit does not accrue on bookings that are cancelled, unpaid, refunded, disputed, charged back, or deemed by the Organizer to have been made in breach of the Terms.

If, after the Promotional Benefit has accrued or been paid out, a refund, cancellation, complaint, chargeback, or other event occurs resulting in the Organizer's loss of the Platform Fee, the Organizer may adjust the Participant's balance or deduct the corresponding amount from future Promotional Benefits.

7. Payout of the Promotional Benefit

The Promotional Benefit is paid out by the Organizer from the Organizer's own funds.

Payout is made to the bank account indicated by the Participant, after reaching the minimum payout threshold of 50 PLN (€15 / CHF 15) gross.

Payouts are made once a month, within 30 days from the end of the month in which the Participant reached the payout threshold, provided that all data and documents necessary for settlement have been provided to the Organizer.

If the Participant does not reach the payout threshold in a given month, the accrued Promotional Benefit carries over to the next settlement period.

The amounts of Promotional Benefits indicated in the Service are gross amounts, i.e. before deduction of any taxes, contributions, fees, or other public charges, if applicable.

The manner of settling the Promotional Benefit depends on the Participant's status, in particular on whether the Participant acts as an entrepreneur, under unregistered activity, or as a natural person not conducting business activity.

The Organizer may make the payout of the Promotional Benefit conditional on the Participant issuing a correct accounting document, submitting a tax declaration, or providing other information required by law.

The Participant is responsible for the correct tax settlement of the Promotional Benefits received, unless mandatory regulations impose certain obligations on the Organizer.

8. Personal data

The controller of the personal data processed in connection with organizing the Program is the Organizer.

The personal data of Participants and Invited Guides is processed in particular for the purpose of organizing the Program, verifying that the conditions of participation are met, accruing and paying out Promotional Benefits, handling complaints, fulfilling legal obligations, and pursuing or defending against claims.

Detailed information on the processing of personal data is provided in the Privacy Policy available in the Service.

To the extent that the Participant independently obtains or uses the personal data of third parties in order to send them an invitation to the Service, the Participant is responsible for the lawfulness of such actions, including holding an appropriate legal basis or consent for contact.

9. Complaints

Complaints regarding the Program may be submitted: by e-mail to: kontakt@realhealers.com; in writing to the Organizer's registered address; via the contact form available in the Service, if provided.

A complaint should contain data enabling identification of the person submitting it, a description of the matter, and the expected manner of its resolution.

The Organizer will consider the complaint within 30 days from the date of its receipt.

The response to the complaint will be provided in the same form in which the complaint was submitted, unless the person submitting it requests a different form of response.

10. Liability and exclusion from the Program

The Participant is liable for their actions undertaken within the Program, in particular for the manner of sharing the Referral Link or Referral Code.

The Organizer may exclude the Participant from the Program, refuse to accrue the Promotional Benefit, or withhold its payout if the Participant: breaches the Terms; breaches the law; undertakes spam or misleading activities; infringes the rights of third parties; creates fictitious accounts or self-refers; acts to the detriment of the Organizer, the Service, clients, or other Guides.

Exclusion from the Program does not affect the Participant's rights to Promotional Benefits that became due before the exclusion, unless they were obtained in breach of the Terms.

11. Amendment of the Terms and termination of the Program

The Organizer may amend the Terms for important reasons, in particular in the case of: a change in the law; a change in the Service's operating model; a change in the settlement rules with Guides; the need to counteract abuse; a change of payment operator or the technical handling of payouts; a change in the Program rules or the amount of Promotional Benefits.

The Organizer will inform Participants of an amendment to the Terms via the Service or by e-mail.

An amendment to the Terms does not affect Promotional Benefits that became due before the amendment took effect.

The Organizer may terminate the Program, giving notice of the end of the promotion with a 30-day period. After the Program ends, new Promotional Benefits will not accrue, unless the Organizer expressly decides otherwise.

12. Final provisions

In matters not regulated by the Terms, the Service terms and the generally applicable provisions of Polish law apply.

The Terms are available in the Service in a manner enabling them to be downloaded, stored, and reproduced.

Participation in the Program means acceptance of the Terms.
